Clarify your doubts by consulting your particular case
Under the general regime of the General Tax Law, a reconsideration appeal (recurso de reposición) is optional. The taxpayer may file it with the body that issued the act or, where the act is subject to an economic-administrative claim, go directly to the competent tribunal. As a general rule, reconsideration is not a prerequisite for an economic-administrative claim (Articles 222 and 235 LGT).
There is no general rule that one route is always faster or more likely to succeed. The reconsideration appeal is decided by the body that issued the act; the economic-administrative claim is decided by the competent tribunal, which exercises its review functions with functional independence. The choice depends, among other matters, on the grounds and evidence in the particular case, which reviewing body is appropriate, and any special rules that apply.
If reconsideration is filed first, an economic-administrative claim against the same act cannot be brought until the appeal has been expressly decided or may be treated as dismissed by administrative silence. If no express decision has been notified within one month after filing, the taxpayer may treat the reconsideration appeal as dismissed for the purpose of bringing the appropriate claim. If both routes are filed against the same act within the time limit, the one filed first will be processed and the other declared inadmissible (Articles 222.2 and 225.5 LGT). They should therefore not be filed in parallel.
As a general rule, the time limit to start either route is one month from the day after notification of the act, or from the day after the effects of administrative silence arise, subject to specific rules for certain cases. Check the appeal instructions in the notice and the applicable legislation before choosing: in some areas, including certain local-tax matters and foral tax regimes, different rules may apply to jurisdiction or access to the economic-administrative route.
Challenging an act does not automatically suspend collection of a tax debt. If suspension is needed, it must be requested and the applicable guarantee requirements met. If reconsideration is chosen, a guarantee may be extended to the subsequent economic-administrative proceedings if requested in accordance with the regulations. Challenged tax penalties are subject to automatic-suspension rules. The choice of appeal and the request for suspension are separate matters (Articles 224 and 233 LGT; Articles 25 and 39 of Royal Decree 520/2005).
In short, reconsideration gives the issuing body an opportunity to review its own act; a direct economic-administrative claim goes to the tribunal without first using that review stage. The choice should be based on the circumstances and the notice of appeal rights, not on an assumption about the speed or likely outcome of either route.

I had a really urgent problem in the middle of the summer that I needed to get fixed. I tried contacting a bunch of agencies but they were either unavailable, slow, had terrible service or were crazy expensive (one company quoted me 1000€!). Josep replied to me within 10 minutes and managed to submit my forms on the deadline and all for a great price. He saved my life - 100% recommend!
