Clarify your doubts by consulting your particular case
Short answer: it depends on the appeal route, the challenged act and whether the debt is already in the enforcement period. Filing an appeal or claim does not, by itself, suspend collection except where the law expressly provides otherwise.
Suspension in an administrative reconsideration appeal
Under Article 224 of the General Tax Act (LGT), automatic suspension may be requested by securing the amount challenged, the default interest generated during suspension and the surcharges that would apply if the guarantee were enforced. Statutory forms include a deposit of money or public securities; a joint and several guarantee from a credit institution or mutual guarantee company; a surety insurance certificate; and, in cases provided by tax rules, a personal and joint and several guarantee from taxpayers of recognised solvency. The guarantee must meet the applicable requirements and cover the required amounts.
Suspension without a guarantee may also be requested where the act may have been issued with an arithmetic, material or factual error. If only part of the debt is challenged, the undisputed part must be paid.
Suspension before the economic-administrative tribunals
Article 233 LGT governs suspension before the economic-administrative tribunals. If the standard guarantees for automatic suspension cannot be provided, other guarantees considered sufficient may be accepted. The tribunal may waive guarantees in whole or in part if enforcement could cause harm that is difficult or impossible to repair. Suspension without a guarantee may also be requested where an arithmetic, material or factual error is alleged. These routes require an application and a decision by the competent body; filing the claim alone does not automatically suspend collection. Supporting documents should substantiate the grounds relied on.
If enforcement proceedings have already begun
Suspension of the challenged act must be distinguished from suspension of enforcement proceedings. Under Article 165.2 LGT, the collection authority must automatically suspend enforcement without a guarantee if it is shown that the debt has been paid, remitted, set off, deferred or suspended; that the right to collect is time-barred; or that an arithmetic, material or factual error affected the determination of the debt. The application should include evidence of the relevant circumstance.
During the enforcement period, filing an economic-administrative suspension request based on a different guarantee, a full or partial waiver of guarantees, or an alleged factual error does not by itself stop collection measures. If suspension is later granted, measures taken after the application date may be annulled under Article 233.9 LGT. Tax penalties have a separate rule: their enforcement is automatically suspended without a guarantee when challenged in administrative proceedings, under Article 212.3 LGT.
What to check
- Which act is being challenged and which appeal or claim was filed.
- Whether the debt is still in the voluntary payment period or is in the enforcement period.
- Which part of the debt is disputed and what the guarantee must cover.
- Whether a ground for suspension without a guarantee applies and what evidence supports it.
Legal basis: Articles 165, 212.3, 224 and 233 of Law 58/2003, the General Tax Act. The correct route depends on the act, procedural stage and evidence in the individual case.

I had a really urgent problem in the middle of the summer that I needed to get fixed. I tried contacting a bunch of agencies but they were either unavailable, slow, had terrible service or were crazy expensive (one company quoted me 1000€!). Josep replied to me within 10 minutes and managed to submit my forms on the deadline and all for a great price. He saved my life - 100% recommend!
