Clarify your doubts by consulting your particular case
A tax inspection may uncover facts that point to a tax infringement and propose a penalty. A tax adjustment does not, by itself, make the taxpayer liable for a penalty: liability requires a separate assessment of the statutory infringement and culpability, and the penalty must be imposed by the competent body through the legally prescribed procedure.
CULPABILITY AND THE TAXPAYER’S DUE DILIGENCE
Under the General Tax Law (Ley General Tributaria, LGT), tax infringements are intentional or negligent acts or omissions defined by law. Negligence may suffice, but liability is not objective: the authority must establish and explain the taxpayer’s culpability in the particular case. The presumption of innocence applies, and the Administration bears the burden of proving the facts on which the penalty is based.
There is no liability where the taxpayer has exercised the necessary diligence, including where the taxpayer relied on a reasonable interpretation of the applicable rule or followed the published criteria of the tax authorities. A taxpayer who voluntarily corrects an earlier erroneous return before the Administration intervenes is not liable for an infringement consisting of that initial filing, without prejudice to any applicable late-filing surcharge or liability for a later infringement. A surcharge or enforcement action does not, by itself, rule out a penalty for a separately established infringement.
HOW THE PENALTY PROCEDURE WORKS
As a general rule, the penalty is dealt with in a separate proceeding from the tax assessment. An exception applies to an agreement assessment record (acta con acuerdo), where the penalty proposal may be included if the statutory requirements are met and the taxpayer expressly waives the separate proceeding. Any penalty proceeding must respect the rights to notice, access to the file, make representations and offer evidence.
The proceeding is initiated ex officio. Before the penalty proposal is made, relevant evidence obtained in the inspection must be formally included in the penalty file. The reasoned proposal must state the facts, their legal classification, the proposed penalty and the criteria used to determine it. The taxpayer is normally given 15 working days to make representations and submit evidence.
The decision must explain the evidence and its findings on the infringement and the taxpayer’s responsibility, identify the person responsible, and state the penalty and any applicable reductions. If liability is not established, the decision must say so. A proceeding initiated after a tax assessment must be opened within six months of notification of that assessment. The ordinary maximum period for completing the penalty proceeding is six months from its initiation. Expiry ends the proceeding, without prejudice to any new proceeding that the law permits.
CURRENT STATUTORY CATEGORIES
The LGT classifies tax infringements as minor (leve), serious (grave) or very serious (muy grave), according to the statutory definition and the circumstances of each case. The former categories of “simple” and “serious” infringements, and the historical amounts expressed in pesetas, are obsolete and should not be used to assess a current case. The penalty and any reduction depend on the specific infringement and the applicable statutory rules.

I had a really urgent problem in the middle of the summer that I needed to get fixed. I tried contacting a bunch of agencies but they were either unavailable, slow, had terrible service or were crazy expensive (one company quoted me 1000€!). Josep replied to me within 10 minutes and managed to submit my forms on the deadline and all for a great price. He saved my life - 100% recommend!
